General Terms and Conditions

Scope

The General Terms and Conditions (GTC) govern the contractual relationship between Tru Life GmbH (hereinafter referred to as Seller) and the Customer (hereinafter referred to as Customer) and apply in the version valid at the time of the order. Customer in the sense of these GTC is any natural or legal person who can conclude a legal transaction for a purpose. Tru Life GmbH expressly reserves the right to change these GTC at any time.

Products

The Tru Life GmbH product range includes products for health and well-being. The pictures of products are for illustration purposes, the delivered/sold goods may differ from these. Products are delivered properly stored, originally packed and not expired. Any further warranty is excluded, especially for properties and effects of the products, as far as the legal regulations allow. Claims for damages due to possible errors in the illustrations or in the prices and texts cannot be asserted.

Order

An order comes about as soon as the customer places an order in the online shop. Orders are only possible with a valid address. Orders can be rejected without giving reasons. With each order, the customer receives an order confirmation by e-mail, which again contains all the details and the expected delivery period. The receipt of the automatically generated order confirmation does not contain any promise that the ordered products can actually be delivered. It merely indicates that we have received the submitted order and that the contract has been concluded subject to the condition of delivery and correct pricing. In the event of a substantial price error of the ordered products, the order may be (partially) cancelled by the seller. Orders oblige the seller to accept the products and services. Subsequent changes or cancellations of orders by the customer are not always possible and may be rejected.

Delivery / Shipping / Pickup

The seller delivers the ordered goods to the desired valid address. For each individual product in the shop a delivery period is visible. In rare cases, especially in case of delays with our suppliers, the delivery may take longer than indicated. Usually we will then ship the already available items as partial delivery and the remaining items as soon as possible. If an ordered product is no longer available, the order will be (partially) cancelled and any amounts already paid will be refunded. Claims for compensation for late delivery or non-availability of products cannot be made. Delivery is considered to have taken place when the product is handed over to the post office. The benefit and risk of the goods shall pass to the customer upon handover to the post office. When an order is dispatched, a confirmation is sent by e-mail to the e-mail address provided when the order was placed. The shipping costs can be seen under the heading “delivery conditions”.

Terms of payment

We offer the following options for paying for an order: Visa, Mastercard and TWINT.

Retention of title

Retention of title applies: The goods remain the property of the seller until full payment by the customer.

Prices

The prices are net, in Swiss francs, including value added tax (VAT) and, if applicable, including an advance recycling fee (“vRG”).

Place of jurisdiction

All legal relations between the seller and the customer are subject to Swiss law. Zurich is the exclusive place of jurisdiction.

Return

For a return in justified cases, for example in case of wrong delivery, the seller must be informed immediately by e-mail. If a return takes place, it must be received by the seller in its original packaging within 10 calendar days with sufficient postage. In case of defects caused by the seller, the buyer will be refunded or a free replacement will be delivered. The seller is not obliged to deliver a replacement if he can prove that he is not responsible for the defect for which he has been notified, for example in the case of defective products or services of third parties or in the case of subsequent modification of the products by the customer. Claims for damages due to possible errors in the illustrations or in the prices and texts are excluded.
